The legitimate rights of holder of the registered patent are the exclusive right on the production, utilization, sell of the invention and the printing of ‘Thai Patent ’ or its Thai initials on the packaging for advertising purpose as well as the assignment of others to exercise the rights. The patent holder is also able to transfer the exclusive rights of the patent to others providing the contract is made in written form and registered with the presence of the official. The said rights are also applicable to the holder of the petite patent.

The violation of the patent is the act on the counterferfeiting, reproduction, modification of the invention without prior permission from the patent’s holder. The violation is opened to the lawsuit both on civil and criminal cases.The punishment for the wrong-doer according to the law included the imprisonment,fine and confiscation.
